Because Jacobsen was not allowed to review personally any of his 27 boxes of discovery and his attorney was instructed to inform Jacobsen of the facts in the files and how to plea. The 27 boxes of discovery refer to many other crimes to include a multimillion dollar theft of US currency. Also, theft from the America West Arena in Maricopa County. Jacobsen stated to the Judge he believed that the Patriot Act was being applied to him. Within seconds of that statement, the Sheriff pulled Jacobsen to the exit door so he could not speak.
Jacobsen has been forced drugs(rohypnol/ketamine) to make him loquacious to multiple homicides he is a suspect in.
The body of Martinez had multiple human bite marks on her suggesting a man over six foot and there was serology that Jacobsen stole from the medical examiner's office when he stole the body in mid examination.
Then there was the fact there was foot impressions with plaster casts taken that do not match Jacobsen's foot size or style of boot the police uncovered at Jacobsen's arrest. The size at the locations of Martinez and Rios were size 12.
Both Martinez and Rios had feces under their fingernails that enzymes were not theirs suggesting possible consensual sex. Police in April 1997 identified in a stakeout of the body of Martinez a possible law enforcement connection because after the body was found, later that day, a vehicle at 2:00 AM turned off their lights and approached the burial site and officers heard the person using a scanner with their unpublished frequency or a police radio talking. Jacobsen on that day was talking to a woman (Gretchen Jones) on the hotel (Weston) phone that logs in all calls and Jacobsen was where he said he was.
Subsequently, when Jacobsen was arrested police compared tire tracks to the scene of the crime and they did not match nor did any cellular frequency that was fixed on Jacobsen's multiple vehicles or skytell 3 way pager that can be identified with position and telemetry with cell towers.
Jacobsen was also under intensive surveillance and was being followed by US Customs 24 hours a day.
In fact, Jacobsen's cell phones and pager revealed movement many miles away from the location of Martinez suggesting Jacobsen had little involvement or culpability up until that point.
However, Jacobsen did contact a judge in May who owned the mortuary where Martinez was to be processed(Judge Bruce Griffith).
Amazingly, there is no DNA of Martinez, who was supposedly murdered in the Phoenix store in April of 1997
However, Martinez was stabbed in the leg while dead suggesting anger or sexual foreplay by a serial killer. The knife used was identified as a gold small "Batton knife" purchased by Richard Harmon from the wholesaler Rothco and was found at his home in Tempe, Arizona.
There was DNA but the technology at the time was not enough to identify who it belonged to.
Martinez was also having a sexual relationship with Harmon and supplying marijuana for her epilepsy.
Jacobsen is not responsible for the culpability of the murder of a 16 year old prostitute and escort as described by her uncle told to Phoenix police.
Then there is the fact of the murder of Rios(age 20) and her husband Mark Hollinger(age 32) that were smoking methamphetamine, PCP, and "shirm" before coming into Jacobsen's store(Jacobsen was an informant for the FBI in Las Vegas and reported to S/A Brian Ford and his supervisor Karen Knowles weekly)in las Vegas, Nevada.
In 1996, Jacobsen was having an affair with a junior federal prosecutor in the Phoenix office.
Jacobsen is believed to have joined the mafia family in support by Ralph Staino of Philadelphia who named Jacobsen Craig "Crackers" Jacobsen and sold thousands of stolen computers to STM Robotics out of Mt. Holly owned by Matthew Monforte and his son.
Sean Monforte and two employees were going to kill Jacobsen to protect the company that Jacobsen helped take public on the stock exchange in New York making millions.
Even Andrew Sinsigalli, who was Jacobsen's stock broker and was referred by the mob to do business with Jacobsen wanted him "silenced".
Jacobsen told the FBI the last he heard of the Monforte and his son was when Jacobsen called to ask for his money and they hung up on him. The amount was $120,000.00 a months worth of stealing computers.
The first good indication of a fair deal by the prosecution in las Vegas was by Gary Guyman who was approached with a deal for manslaughter for the death of Ginger Rios, but in the meantime Jacobsen had to get an evaluation at Nevada's state hospital.
While Jacobsen was at Lakes Crossing (state hospital) he was spooked by the words of an oriental man that told him to keep his mouth shut or he would be killed by him. Weeks later Jacobsen was informed that the Oriental who threatened him was found dead, shot in a dumpster in Vegas.
Incidentally, Jacobsen's former psychiatrist, Dr. Sore, MD from Las Vegas, who's sister was aware of Jacobsen/Flowers worked on the remains of Martinez and is a suspect in him helping destroy the evidence and testing of DNA..she is a pathologist?
Jacobsen was extracted from the Arizona Prison Complex from the states psychiatric unit where he was being forced psychotropics that were causing him cardiac issues. On November 9th, 2023 the ambulance was called to pick Jacobsen up because he was experiencing chest pains and instead Captain Defeo turned the ambulance away and told Jacobsen that the institute would take him to the hospital. Instead, the FBI(Agent Burrows), Homeland Security, and Maricopa County Sheriff's Department picked Jacobsen up for a 12 hour interrogation and upon arriving back at the prison hospital within hours was taken to death row at Browning unit and was immediately taken to Mount Vista Hospital for 10 days for heart related issues due to psychotropics.
Jacobsen while in the hospital was allowed to use a cell phone and was taught all kinds of features available to browse the internet.
